ESTA and PIE Explained for Landowners: What Every Property Owner Needs to Know

What is ESTA?

ESTA stands for the Extension of Security of Tenure Act. This law mainly applies to farms and rural land. It’s there to protect people who live on your land with your permission, like farmworkers or tenants, especially if they’ve lived there a long time.

Even if they stop working for you or you want to use the land for something else, you can’t just kick them out. The law says you must follow a proper legal process and get a court order before anyone can be evicted.

What is PIE?

PIE stands for the Prevention of Illegal Eviction Act. This one applies to urban properties – things like houses, flats, or land in towns and cities.

If someone is living on your property without your permission, even if they moved in illegally, you still can’t remove them on your own. The law says they must be treated fairly and with dignity. You need to give them proper notice, and again, go through the courts.

Why does this matter?

As a landowner, this can feel frustrating. You paid for the property, so why can’t you just remove someone who’s not supposed to be there?
