What Is Prescriptive Acquisition?

Prescriptive acquisition is a legal principle that allows a person to become the owner of property through long-term possession.

If you have occupied and treated a property as your own for a continuous period of more than 30 years, you may have acquired ownership by prescription. This can arise in various situations, including long-standing family arrangements or where ownership has never been formally transferred.

Although ownership may have been acquired in law, the property cannot simply be sold or transferred until your ownership has been officially recorded in the Deeds Registry.

How Can Ownership Be Registered?

This is where Section 33 of the Deeds Registries Act plays an important role.

Section 33 provides the legal mechanism for registering ownership where a conventional transfer is not possible. Rather than relying on a signed transfer from the registered owner, an application is made to the court to recognise the ownership acquired through prescription. Once the court grants the necessary order, the ownership can be registered in the Deeds Registry.

This process transforms long-term possession into formally registered ownership.
